General Terms of Service

Introduction

These terms of service ("Terms") govern the use of Schneider Mechanical Systems Inc. ("Schneider Mechanical Systems", "we", "us", or "our") website, products, and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

Services

Our company provides plumbing, electrical, and HVAC services, including heating, ventilation, air conditioning, and refrigeration installation, repair, and maintenance services to residential and commercial customers.

Payments

Payment for Services is due at the time of service, unless otherwise agreed to by us.

We offer a DUAL PRICE STRUCTURE. This means you get to choose if you want to keep your costs down. As you do, it helps us do the same, enabling everyone to SAVE together! Because of this, we accept payment by cash, ACH check through our invoicing pay-links with no fee, and credit card or debit card with a 3.75% fee via our invoicing pay-links.

In the event that payment is not received by the due date or the payment is returned, we reserve the right to charge insufficient funds fees (2024 Rate $49.00) and other costs associated with collecting the outstanding balance, including interest on the unpaid balance at the rate of 18% APR -OR- the maximum rate allowed by law, whichever is more, plus collections services fees, attorney's fees, mechanic's lien fees, and/or foreclosure or other proceedings or actions relating to the collection of outstanding balances.

Past Due Accounts

Our goal is to provide quality service that our clients can depend on. As we do, it is imperative that services rendered are paid upon completion. We do NOT offer credit accounts.

Monthly Late Fees Schedule 2025

• $30.00 for balances less than $500.00
• $60.00 for balances between $501.00-$1,499.99
• $90.00 for balance $1,500.00-$5,000.00
• $120.00 for balance over $5,000.00 will be assessed to past due balances monthly following the courtesy Net 7 Day period plus interest as stated in the PAYMENTS section.

Balances that remain outstanding over 7 days will be subject to additional collections, attorneys' fees, mechanics liens, or other actions made in an effort to collect the balances outstanding. All payments will be applied to Late Fees and Interest first and principal balance last, regardless of the memo noted by client remittance.

Scheduling

We will make every effort to schedule Services at a mutually agreed-upon time. However, we reserve the right to reschedule or cancel Services due to unforeseen circumstances, including but not limited to inclement weather, equipment failure, or employee illness.

Warranties

All new installations come with a 1-year parts and labor warranty. Extended warranty periods are available via our LOYALTY ADVANTAGE PLANS. As part of this, we warrant that Services will be performed in a professional and workmanlike manner and in accordance with industry standards. If you are not satisfied with our Services, please notify us within 48 hours of completion of the Services, and we will make every effort to remedy the situation. Warranties are only valid when services are paid in full and on time. Should payments be delayed due to no fault of us, all warranties are void and null due to failure to pay and complete totality of service remittance after services are provided.

Extended Warranties

Any extended warranties are defined by the details in the correlative invoice(s) and supporting source document(s) as/if applicable. Extended warranties that are on installment plans, which become outstanding and remain unpaid, are deactivated immediately with a 60-day period to reactivate before warranty benefits are NULL and VOID.

Limitation of Liability

To the maximum extent permitted by law, Schneider Mechanical Systems Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Services; (ii) any conduct or content of any third party on the Services, including without limitation, any defamatory, offensive, or illegal conduct of other users or third parties; (iii) any content obtained from the Services; or (iv) unauthorized access, use, or alteration of your transmissions or content.

Indemnification

You agree to indemnify and hold harmless Schneider Mechanical Systems Inc., its affiliates, officers, directors, employees, agents, licensors, and suppliers from and against any claims, actions, suits, or proceedings, as well as any losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to (i) your use or misuse of the Services, (ii) any User Content you submit, post, transmit, or make available through the Services, (iii) your violation of these Terms, or (iv) your violation of any rights of another.

Modification of Terms

We reserve the right to modify these Terms at any time. Any changes to these Terms will be posted on our website, and you agree to be bound by such changes. If you do not agree to the new or modified Terms, you should not continue to use our Services following such change(s) that you feel are unacceptable.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law provisions. Any disputes arising under or related to these Terms shall be resolved exclusively by the state and federal courts located in the City of Lakewood within Jefferson County, Colorado.
